The statement of the claim shall be filed with the clerk of a municipal court in the town in which the defendant or the plaintiff resides. If there is no municipal court in the town in which the defendant or the plaintiff resides, the statement of the claim shall be filed with the clerk of the district court in which district the defendant or the plaintiff resides.
